Joe’s Missing Too Many Votes Says Arlen

Sen. Arlen Specter (Former Republican) is saying the man who is running against him in Pennsylvania’s May 18 Democratic Primary is missing too many votes.

Congressman Joe Sestak (D-7) has missed 122 votes or nearly 17 percent of his total this year Arlen said in a news release. Arlen says he sent a letter to Joe in which he says “It’s okay to want to campaign full time for a promotion to the U.S.
Senate but it’s wrong to continue to do it on the taxpayer’s dime –
they deserve better, they deserve a full time Congressman. Serve or
quit – it’s that simple.”

Ouch.

In fairness to Joe, it’s not like he’s flying to party in Copenhagen while ducking phone calls from our generals in Afghanistan.

Arlen will be appearing at a campaign rally in Bucks County 5-7 p.m., this afternoon with Vice President Joe Biden and Congressman Pat Murphy, who has missed just 6 votes in the 111th Congress.

The goods news is that Arlen and Joe have both fallen behind Pat Toomey — a man not driven by ego — in the polls.

Filmmaker Michael Moore has just released the movie “Capitalism: A Love Story” and conservatives are outraged.

The movie apparently rakes our economic system over the coals and the plutocrats point out that the multi-millionaire auteur has done quite will by it.

But has he? Has he really done well under our system?

If he lived in North Korea do you think he would he be anywhere near as obese?

FYI, Moore apparently used non-union stage hands to make the film.

If true, the deal is dead and things go back to square one.

An agreement was reached, yesterday, to remove four dams on the Klamath River on the California/Oregon boarder and restore a 300-mile migratory route for salmon.

So while we can count on China and Mexico supplying us with the lost food, what is going to replace the electricity? It will come from less insane states and be produced mostly be coal and natural gas plants which pump out greenhouse gases, especially the former.

So why aren’t those concerned about global warming screaming to save the dams? It’s because they really aren’t concerned about global warming.

IOW, it’s bunk.

Americans Want Bills Online Before Vote — A new Rasmussen Reports national telephony survey shows that 83 percent of Americans think legislation should be posted online in final form and available for everyone to read before Congress votes on it sans emergencies. Six percent don’t and 10 percent aren’t sure.

John F. Peoples, a 60-year-old blind lawyer from Broomall, Pa., lost his federal case in Philadelphia, Sept. 22, when  U.S. District Judge Edmund V. Ludwig dismissed the claims of civil rights violations and breach of contract Peoples alleged against Discover Financial Services, and the woman he said he was paying for sex.

About 20 or so years ago, Peoples was known as the blind guy who got around Delaware County by hitchhiking. He still has not lost his self-confidence.

Peoples, in his suit, claimed he paid Ginger Dayle Productions (a Pennsylvania corporation) and New City Stage Company (a trade name) for “services” for March through November 2007 at Ginger’s apartment.

“I paid her and she had sex with me and there was an understanding that it was payment for sex,” Peoples said in deposition.

Well, Peoples said he relied on Ginger to enter agreed upon amounts on his credit card receipts and in several instances she entered larger amounts, which were charged to his Discover Card.

Ginger, btw, says the services were for physical fitness instruction and countersued Peoples saying he made sexual advances and grabbed her without permission.

There were at least 25 transactions that Peoples said was supposed to be at $275 each. He said though that in October and November he was billed for 10 of them at $1,100 and one at $1,600.

People’s told Discover that the overcharges were fraudulent but his claim was not accepted. So, hence the lawsuit against Ginger (and her corporation) and Discover which he claimed failed to live up to its fraud protection policy and to accommodate his disability as per the American With Disabilities Act and other laws. With regard to breach of contract, Discover noted that the purchase of prostitution services is unlawful in Pennsylvania and hence was a violation of the Cardmember Agreement, a point which Ludwig accepted.

Ludwig dismissed the disability claims for a host of reasons.

And once the Discover claims were dismissed, the suit against Ginger Dayle and her countersuit against Peoples were no long a federal matter, and hence dismissed without prejudice. Theoretically they could still end up in state court.

Let’s Make It Easier To Rent The Home You Buy — The New Jersey property tax is a burning issue in that state’s gubernatorial race with incumbent Democrat Jon Corzine and Republican challenger both agreeing it is a big problem.

The Philadelphia Inquirer notes that The Garden State has the highest in the nation albeit TaxFoundation.org says that Texas held the crown in 2008 — note Texas does not have an income tax.

So that brings us to Pennsylvania which is 11th highest in property taxes according  TaxFoundation. The property tax is the cruelest tax. You lose your income you don’t pay an income tax nor would any food or clothing you buy be taxed. The government still, however, wants you to cough up something for your home.

The sad thing is that Pennsylvanians could see a nice cut in their property tax burden with some simple changes to the law, and even though they would be spending less money  they could see services improve.

The first and most profound reform would be to prohibit teacher strikes. Pennsylvania is one of only 13 states to allow teacher strikes. Without this heavy club you would not see 4-5 percent annual raises for PSEA members — who include guidance counselors and nurses along with classroom teachers.

Next would be to repeal the prevailing wage law. The law, passed in 1961, requires that contractors pay wages set by the state Department of Labor and Industry for all public works projects. The Commonwealth Foundation estimates that labor costs for public sector construction jobs in Pennsylvania average 37 percent higher than what the private sector pays for the same work because of this. Nine states have repealed their prevailing wage laws while nine others never had any.

Finally, we repeal the The Pennsylvania Separations Act of 1913, an archaic but expensive law that requires that public entities solicit separate bids and award separate contracts for electrical, heating, ventilating and plumbing work undertaken as part of public construction projects in which costs exceed $4,000.

Bet next year’s tax bill that if these reforms were passed the cost of owning your home — or would that be renting the home you buy? — go down.

Oprahization Of the Delaware County D.A. — The prosecutors in the Delaware County (Pa) District Attorney’s office seem to be watching Oprah Winfrey when they should be reading Jefferson and Blackstone.

Delaware County Daily Times columnist Gil Spencer had articles, here and here, regarding a father who was brought to trial on various child sex charges solely on the word of a disturbed young neighbor who had a known grudge.

The prosecution had no corroborating evidence and Sherlock Holmes was not needed to see inconsistencies in the girl’s story i.e porn was not found in the house. Nor did there seem to be any consideration — or maybe even investigation — into the history of the accused and accuser, or the accuser’ background.

Fortunately, the jurors had a better understanding of truth and justice than the trained lawyers. The man was acquitted albeit at a cost of $10,000 in legal fees.

And, of course, innocent men can go to jail.

The Fairbanks Daily News-Miner,  an anti-Sarah Palin publication in our 49th State, labeled a photograph of the governor “A broad in Asia” regarding her Hong Kong address.

Which lead to this desperate apology from Managing Editor Rod Boyce. I assume he’s going to keep his job which would likely not be the case if Hillary Clinton had been the subject.

Liberals are the biggest hypocrites. Progressives are the biggest phonies. Don’t trust any of them.

Screwups Hail Obama — So this is what we get for the $787 billion American Recovery and Reinvestment Act? A $3,000 green sign and  a solution to a problem that should never have existed and matters worse — at least with regard to things like convenience, traffic and pollution — than it was before a certain government agency tried to fix things.

The sign, which also has an orange top depicting a man digging a ditch and the words “Putting America To Work” went up Sept. 23 at the Springfield Road stop for SEPTA’s Route 101 trolley in Springfield, Pa. SEPTA, btw, never bothered to consider PennDOT’s concerns before starting the project which involved installing traffic-safety gates, removing the traffic-safety gates and changing a decades-old scheme so commuters now must cross the busy highway at least once per round trip, at a spot, mind you, where it is illegal to do so.

And why does Obama think that Americans being forced to earn a living digging ditches is somehow progress? I’d like to see him dig ditches.\
