No Indictment Policy Violates Constitution Commissioners Told — Chester County was put on notice, Aug.13, when Washington D.C.-based civil rights activist Jessica Saxton and civil rights attorney Tanawah Downing.

“I am here to put to Chester County Commissioners,” Ms. Saxton told the board.

She explained that that the Constitution prohibits unless indicted by a grand jury.

She said Chesco, along with the rest of Pennsylvania, allows police officers to charge “by information” and ignore indictment.

This is illegal and unconstitutional.

Downing said that federal law states that any person under the color of a state statue or ordinance who deprives anyone of his constitutional rights, commits a crime, as does anyone who conspires to do so.

The latter would apply to the commissioners.

He said he has already prepared criminal affidavits and will turn them into criminal complaints if Chesco does not fix things.

Among those who have prosecuted in Chesco without a grand jury indictment is Mary Bush, who was convicted in July 2024 of harassing a man over an inheritance dispute.

Mary actually notes State Police says no crime was committed.

The matters that led to the dispute are a tragedy and perfectly illustrate why reforms are needed regarding the state’s guardian laws.

Military Voters Face Handicap In Pa And Delco Ignores — Delaware County (Pa) Council, Aug. 20, heard that military voters face a significant handicap in Pennsylvania.

As expected, they appear to be ignoring it.

Dave Cleary (phonetic) of Concord told Council that those seeking military ballot are unable to state web portal which makes it convenient to apply for all other mail in ballots.

He said he has discussed the matter with county Election Director Jim Allen who insists it’s not a problem.

“I’ve talked to Mr. Allen quite a bit and he’s tried to convince me that it’s not discrimination or whatever you want to call it,” Cleary said.

Cleary, however, says those at county Office of Veterans Affairs have found the same issue and consider it discrimination.

Cleary also noted that his emails are kicked back when he attempts to contact the Board of Elections.

We’ve heard similar complaints from other activists when attempting to contact the county.

Cleary also mentioned that he faces petty legal retaliation when he criticizes the influential Cappelli family in Concord.

Also concerning election matters, Scott Thomas of Marple debunked claims by Councilwoman Christine Reuther handcounting paper ballots would be impracical.

Tevin Dix of Haverford Township says he has witnessed irregularities concerning mail-in ballots since 2020 including ballots being mailed to vacant addresses.

Lara Lewis of Radnor election system vulnerabilities are becoming more apparent that software can be used to flip voting.

Woodburne Mansion 

John and Jan Haigi of Darby spoke of the need for repairs to the county-owned Woodburne Mansion, and how it would be a great project for Williamson Trade School students.

The 55-room mansion is on a 30-acre tract in Darby on Springfield Road.

Delco Council Gets More Examples Of Crisis Caused By Hospital Closings — Two women at the Aug. 20 meeting of Delaware County (Pa) Council addressed the consequences of closing four major hospitals in the last year.

Peggy Malone, who was a behavioral health nurse at Crozer Chester Medical Center, spoke on behalf of the 2,700 workers there who lost their jobs when it closed four months ago.

She expressed relief that behavioral health services were returning to the community and asked if the crisis stabilization unit would be similar to the robust in-patient unit at Crozer.

The provider, Belmont Behavioral Health Services, made a presentation earlier that night.

Belmont is a Philadelphia-based limited liability corporation.

Ms. Malone was told no, confirming that no-inpatient unit is expected soon in the county.

She asked that Council make a commitment to prioritize hiring those laid off at Crozer.

She noted that many still have not been able to find jobs.

Jamie from Lansdowne who is part of Put People First! Pa noted that 21 other hospitals have closed in Pennsylvania besides the four in Delco.

She it was a crime to watch now vacant Crozer decay.

She says we are in a period of abundance and that the scarcity narrative is false.

Jamie said the poor neighbors are being especially hit hard by decreased options for medical care.

“We need urgent and comprehensive solutions,” she said. “We don’t need little micro-hospitals.”

She said hospitals should not be profit-based and expressed concern about the motivations of Belmont, which, as noted, is a limited liability corporation.

In other words, it’s for profit.

Jamie said that the laid-off workers from all four hospitals be prioritized in any hiring by Belmont.

Anigar Monsee, a resident of Upper Darby, is serving five years probation for four felony counts of videoing herself torturing and kill pets live on YouTube and Facebooks.

Granted the sentence includes 23 months for time served.

The deaths would take several minutes while her daughter would cry in the background.

The animals would be acquired as pets.

Ms. Monsee is a native of Liberia.

Hey Upper Darby, the world in one place right?

Hopefully, Ms. Monsee’s immigration status is investigated.

She was convicted in May and sentenced in July.

By the way, not every one is bothered by this. Inquirer reporter Victor Fiorillo says he’d be fine grilling Guinea pig bought from a pet shop.

Hill Prison Guards Getting 2 Hours Sleep Between Shifts — Albert Johnson of Morton, a corrections officer and union representative at George Hill Prison, told Delaware County (Pa) Council, yesterday, Aug. 20, that the prison remains in crisis especially for the guards.

“It is not safe there,” he said. “Inmates are able to go to any door at any time go into another cell and commit criminal things against each other.”

He said the $25 the county gives the inmates hurts them as they are extorted for it from other inmates.

Further, Johnson said the prison cannot retain officers due to the conditions.

“You see pictures and slides of new classes coming up, maybe one, maybe two will stay,” he said.

He says due to the work scheduling cooked up by the prison administration, officers find themselves getting between “two and three hours sleep between each shift.”

This obviously is a serious safety issue.

Johnson called for a return to split shifts which were in place before this present bunch took over and named the inexperienced Laura Williams as warden.

Ms. Williams is stepping down and Johnson said those he represents desperately want to work with whoever takes over.

Kimberly Brown of Colwyn, a case worker at Hill, was joyful at the impending change in administration.

“It’s a lovely day at George W. Hill,” she said. “Armageddon day is scheduled for Sept. 5.”

That would be Ms. Williams last day.

Ms. Brown warned about naming any of the deputy wardens as interim warden along with other administrators.

Delco Continues To Ignore CYS Issues — LaPenta of Upper Chichester returned to Delaware County (Pa) Council last night, Aug. 20, and again told them the system regarding domestic protective services for children and adults is broken.

She noted victims complaints and concerns are often ignored and real squeaky wheels suffer retailiation.

“While you sit in silence the abuse gets worse,” she said. “Victims don’t come forward because they know nothing will happen. Nothing or worse, retaliation. Family court victims, CYS victims, survivors of this misuse of PFAs, we are silenced. Not only by our abusers but by the very institutions meant to protect us.”

She said she was “exhausted” by being told that nothing could be done and that it if was a councilmember’s family member she could guarantee that something would get done.
