When Pa. Chief Justice Max Baer died on 9-30-22, it necessitated this year’s Pa. Supreme Court race.
On the ballot are Democrat Daniel D. McCaffrey and Republican Carolyn Carluccio.
McCaffrey is a Temple School of Law Graduate. He was an assistant district attorney in Philadelphia (1991-97) and is a US Army veteran.
He seems to be the only Democrat endorsed by The Pennsylvania Federation of Police (PaFOP); The Pennsylvania State Troopers Association (PSTA) and The Pennsylvania State Corrections Officers Association (PSCOA)
He’s also endorsed by the usual suspects, such as Planned Parenthood Votes, and Reproductive Freedom for All.

McCaffery’s brother Seamus was a Pennsylvania Supreme Court Justice but was forced out in a porn email scandal, in 2014.
Judge Carolyn Carluccio is the first female president judge on the Montgomery County Court of Common Pleas.
She is “highly recommended by the Pennsylvania Bar Association.”. She lives with her husband Tom, in Blue Bell and they have raised three children. Mrs. Carluccio has also served as the “first-ever Chief Public Defender for Montgomery County”.
Mrs. Carluccio says she wants a justice system that is “Fair and impartial”

She is endorsed by the Pennsylvania Pro-Life Federation and has also said she rejects “judicial activism” and remarks that “women’s reproductive rights are protected by Pennsylvania Law”.
“We will uphold that law and only the Governor and Legislature can change it,” she said.
Other groups supporting her include The Commonwealth Leaders Fund and the Pa Future Fund.
“The Legislature is elected to make law,” she says.
She notes, though, that the judiciary has the power to overturn law clearly erroneous.

I wouldn’t vote for McCaffery because of his worldview, and he belongs to the party of the progressives, but what does his brother’s conduct have to do with anything, Bob Small? That’s a cheap shot.

But one really should ask why out of all the people in this state, it is the brother of a disgraced former Supreme Court justice who is the Democrat nominee for a Supreme Court seat.

Actually there is a connection there. “The Philadelphia Inquirer” (no friend of the Republican party) “reported at the time that then-Justice Seamus McCaffery had sent two lewd emails in early 2014 to Dan McCaffery, who was then a Philadelphia judge.
Dan McCaffery responded to ask Seamus to send such messages to his personal email account, the Inquirer reported.” Quote from Pittsburgh Post Gazette.
So a reasonable person could conclude two things. One, that Judge Dan McCaffery wanted to continue to receive these explicit (or worse) emails from his brother. Two, that Judge Dan McCaffery was smarter than his brother and while he wanted to get those emails (that were so bad that they ruined many careers in addition to that of Seamus McCaffery) he didn’t want to get caught so he asked they not be sent to his court email.

Imagine if Seamus was a noble and exalted justice who left on noble and exalted terms. Wouldn’t Danny be rightfully making an issue of the family connection? Hey same parents, same upbringing maybe some of it might have rubbed off, right?
It’s kind of peculiar the the Dems would pick the brother of a disgraced justice to follow in his footsteps, and it’s even more peculiar the Republicans aren’t pointing this out.
And don’t forget, the nasty emails were just the tip of the Seamus McCaffery iceberg. When he resigned from the court he was facing a slew of other charges too. These included: allegations that he may have fixed a ticket on behalf of his wife; that his wife (who worked for him on the taxpayer dime) collected referral fees from law firms with cases before the court; and that he may have improperly made a call to a top court administrator critical of a judge handling a case involving a law firm that contributed to his campaign and also paid his wife a referral fee.
In an order suspending him, then-Chief Justice Castille wrote: “No other justice has failed to live up to the high ethical demands required of a justice of this court or has been the constant focus of ethical lapses to the degree of Justice McCaffery.”
Carolyn Carlucci was an assistant AG in Delaware in the 1990s when I was a bank executive there. She had an excellent reputation as a hard working and fair prosecutor.She had an excellent reputation.IMO she would an outstanding Supreme Court judge.
It may not be the whole state FOP backing McCaffery, but primarily Lodge 5 which is the Philadelphia PD FOP lodge which is the largest lodge in the state. It is not surprising because Seamus McCaffery was a well respected officer of the Philadelphia PD while going to law school. Once he got his law degree he became a ADA in Philly and climbed the ladder to become a judge in Philadelphia. He is most noted for creating and presiding over the “Eagles Court” at then Vet stadium to control the rowdies, especially those living outside the city. This allowed the city to collect fines for things like drunk and disorderly at the games right on the spot.
I believe his brother was the “iggles judge”.
